Procedure to withdrawal PF of International worker in India

In order to withdrawal the P.F accumulations one need to submit duly signed (employee and employer) Form 19 & 10 C to respective P.F department, attached the same for your requirement.

Following documents are required to withdraw the P.F accumulations.

1) Duly filled hard copies of aforesaid forms along with canceled cheque

2) Need to affix two one rupee revenues stamps at appropriate places on both forms and need to be signed across the stamp.

3) There are 5 Signatures to be affixed at appropriate places ( go through thoroughly the attached forms)

India Signed Social Security Agreement with some Country. If your International worker is coming under that means you can withdraw the amount.

 I have Attached Provident Fund Full Details

Provident Fund Full Details

PF:
1. The Employees Provident Fund Scheme, 1952
2. The Employees Family Pension Scheme, 1971
3. The Employees Deposit-Linked Insurance Scheme, 1976

Calculations: P.F from Basic

Employee: 12% (P.F)
Employer: 3.67% Provident Fund (A/c 1) + 8.33% Pension (A/c 10) + 1.10% Admin Charges on
PF (A/c 2) + 0.50% EDLI (A/c 21) + 0.01% Admin Charges on EDLI (A/c 22)
=>13.61% on basic

* Pension (8.33% or 541/- which ever less)

Regular activities:

1. Time of joining: Form 2: Employee should fill, at the time of joining, nomination & Declaration form.
Form 2, includes the following

· Name of the employee
· Parent/spouse name
· Date of Birth
· Sex
· Marital Status
· AC No
· Address
· Names, address, relation, Share for each etc
Also for changing nominee names Form 2 is used. His eligibility begins on the date of joining the firm. Submitted along with form-5.
2. Withdrawers/Dead : Form 10c (pension) & 19 PF

Form 19 is used for withdrawing PF amount. Employee and parent/spouse name, name of the establishment, Ac no, Reasons for leaving service, Contribution for current financial year etc. Form 10 is used for pension withdrawal.

Form 19: Employee should fill, all information like Bank a/c, name, DOJ…with signature and then
Employer like present year contributions, DOR…for PF Fund – Due date: After 60 Days
of Resignation)
Form 10C: Employee should fill, all information like Bank a/c, name, DOJ…with signature and
then employer like present year contributions, DOR…for Pension Due date: After 60 Days of Resignation

3. Transfer : Form 13

Form 13 is used for transferring an employee AC from one company to another. Both employer and employee have to specify his name, PF AC no, Position etc and submitted with a covering letter (consolidated list of employees). Photocopy of the above is kept in PF file for transfer.

Process details

Form 10 D (For claiming benefits under Pension)

Employee should fill like Expired/late employee name, nomination name, details, Nomination Bank a/c…for monthly Pension

Form 20 (For Claiming EPF Contributions)

Employee should fill like Expired/late employee name, nomination name, details,
Nomination Bank a/c…for withdrawal of PF Fund (Incase of Death of a member

Form 5 IF (For Claiming EDLI benefits, nominee will get benefit)

EDLI for death case, nominee will get benefit.

7. Form 9 (Register of employers – Application for review filed under)

Monthly Remittance / Challans:

1. Challans every month before 15th (4 copies/ quadruplicate)
2. All A/c (A/c Nos-1,2,10,21&22)
3. To Bank
4. both employer & employee contribution

· Account group no eg Ma mu 1246 (state-first two alphabets /city/acc no: of the company)
· Month
· Total number of subscribers
· Total wages due for each account (wages on which calculations are done)
· Each accounts totals (consolidated amount with employer and employee share)

Challan is submitted tp PF office along with form-12A every month.

Monthly returns:

1. Form 12 A, with all information and employees list of contribution before 25th
2. With Form 5 (new joiners list) , form 10 (resigned employees list), challans copy
3. Information about last month employees, new & resigned employees & this month staff.

Form 5

· Name of the establishment and address
· Month
· Code no: of the factory
· A c no:
· Name of new employees
· Fathers or Husband name in case of married women
· Date of birth

· Date of joining the fund
· Total period of pervious services as on the date of joining the fund

Form 10

· Name of the establishment and address
· Month
· Code no: of the establishment

· Name of member who is leaving
· Fathers or Husband name in case of married women
· Date of leaving service
· Reasons for leaving service
· Signature of authorized officer and stamp of the establishment
Cross checking the above is done with the salary statement which includes the number and name all current employees.

Form 12 A:

· Name of the establishment and address
· Currency period and month (April yr to march yr)
· Statutory rate of contribution (12%)
· Group code (NA for unexampled establishment. Establishment having more than 1000 have to keep a PF trust and have to specify the group code)
· Total wages due for each account (wages on which calculations are done)
· Amount of contribution and amount remitted (consolidated amount with employer and employee share)
· Date of remittance
· Total number of subscribers for the current month.
· Name and address of the bank in which the amount is remitted.
· Details of subscribers for E.P.F, PF, EDLI
–No of subscribers as per last month
–No of new subscribers (vide Form 5)
–No of subscribers left service (vide Form 10)
–Total no of subscribers (After adding and subtracting the new and retired employees with,
the number should tally with monthly list of employees)

Cross checking the above is done with the salary statement.

Annul returns:

1. Form 3 A (Individual Computation sheet)
2. Form 6 A (Consolidated Annual Contribution Statement)
3. before 30th April every year

Form 6A:

· Currency period and month (April yr to march yr)
· Name of the establishment and address
· Code no: of the establishment
· No: of member voluntary contributing at a higher rate
· AC No of each employee followed by their name, annual salary, annual contribution, employer contribution, refund of advance, rate of voluntary contribution.
· This grand total should tally with all form 12 A and challans totals.

Form 3A: Register

This form is filled up for each employee stating his each monthly salary, contribution, Employer share, Refund of advance, No of days/period of non contributing service, if any (eg. unauthorised leave). If the employee is resigned during that financial year then the date of leaving service and reasons for leaving service should be specified in this form. Using Form 3A, form 6 A is filled up and crosschecking is done with all challans and 12 A forms.

The following instruction should be carefully read before completing the form.

1.                  Employees’ Provident Fund Scheme, 1952 : Form 20: Claim for the withdrawal of Provident Fund Accumulation of minor/deceased member.

By whom the claim application should be preferred?

 

2.                  If the member is a minor by the guardian.

 

Or

On death of the member :

(a)               If nomination subsists : by the nominee(s) if the nominee(s)/are minor by the guardian of minor(s).

(b)               If no nomination subsists : – by the family member’s (family includes posthumous child if any, except major sons, and married daughters whose husbands are alive, of the deceased member duly supported by list of surviving family members (as on the date of the death of the member) furnished by the last employer or mamlatdar/Tehsildar or Executive Magistrate indicating complete particulars such as name, relationship with deceased member (in the case of parents whether dependant or not) age, marital status. If any family member is a minor by the guardian of minor.

If both (a) & (b) above are not applicable : – by legal heir(s) duly supported by a legal heirship certificate (from the appropriate State Normally Revenue authorities).

3.                  Documents to be enclosed :

(a)               If the application is preferred by a guardian other than the natural guardian or minor member/nominee/family member/legal heir a guardianship certificate issued by competent court of law should be enclosed.

(b)               Death certificate.

(c)               If the amount receivable exceeds Rs. 5000 but less than 25,000 an affidavit-cum-indemnity bond (From may be obtained from the ex-employer of Regional Provident Fund Commissioner or Officer-in-Charge of Sub-Regional Office ……………………) or Estate Duty Clearance Certificate.

(d)               If the amount receivable exceeds Rs. 25,000 on Estate Duty Clearance Certificate.

 

Form 11 (FPF) : Claim for benefits as admissible under the Employee’s Pension Scheme, 1971. By whom claim application should be preferred ?

 

(1)               If the member is minor by his guardian.

Or

(2)               On death of the member :

(i)                 If the deceased had ‘family’ on the day of death the claim should be preferred by.

(a)   the widow or widower.

(b)   Failing (a) above, by the guardian or eldest surviving minor son.

(c)   Failing (a) and (b) above by the guardian or eldest surviving minor, unmarried, daughter.

(i)                 If the deceased member had no family on the day of death, the Family Pension Fund benefit should be claimed by the person(s) eligible to receive the Provident Fund accumulation of the dece3ased member and if such member is a minor by the guardian. *(If the claimant being other than the natural guardian a guardianship certificate issued by the court of law should be enclosed.

 

Important Note : – In case the member died while in service after contributing to the Family Pension Fund for a period of not less than two years, an application in Form 10-A should also be preferred for claiming monthly Family Pension.

(iii) Form 5(F) ‘Benefit under Employees’ Deposit-Linked Insurance Scheme, 1976.

The benefit under Employees’ Deposit-Linked Insurance Scheme, 1976 is admissible to the person(s) entitled to receive the Provident Fund accumulation of the deceased member only under the following conditions.

(1) The death should have occurred while in service and.

(2) The average balance in the accounts of the deceased employees should not be below the sum of Rs. 1000 during the preceding three years of during the period of his membership, whichever is less.

An affidavit-cum-indemnity bond in the prescribed form should be furnished wherever the payment under Employees’ Deposit-Linked Insurance exceeds Rs. 5000 (if amount receivable under Employees’ Provident Fund and Employees’ Deposit-Linked Insurance does not exceed Rs. 25,000 one affidavit-cum-indemnity bond is sufficient).

 

GENERAL

(1)   All the columns in the form should be filled in, in ink, without any overwriting.

(2)   Correct postal address, including PIN CODE will enable to make prompt payment to the correct payee.

(3)   The claimant should also furnished the address in the acknowledgement attached to the claims.

(4)    The literate claimant should sign the application form.

In case of illiterate : – Left hand thumb impression by illiterate male claimant and right hand thumb impression by illiterate female should be affixed in the claim form.

(5)   Attestation of claim application : – The application should be submitted through the employer under whom the member was last employed if for any reason the claimant is unable to submit through the employer, the claim may be got attested with official seal by any one of the following officials. (I) Magistrate; (ii) A gazetted officer; (iii) Post/Sub-Postmaster; (iv) President of Village Union; (v) President of the Village Panchayat where there is no Union Board; (vi) Chairman/Secretary/Member of the Municipal/District/Local Board; (vii) Member of Parliament/Legislative Assembly; (viii) Member of C.B.T. Regional Committee of the E.P.F.; (ix) Manager of the Bank where claimant has account; (x) Head of any recognised educational institution or ; (xi) Head of any recognised educational institution or; (xi) Any other official as may be approved by the Commissioner.

(6)   Instruction to employers :

While forwarding the claims the employer should ensure that all the information required in the claim furnished correctly and requisites documents are enclosed in support of claim under Employees’ Family Pension Scheme, 1971 the period of break in reckonable service (i.e. period for EPF contribution is not payable should be furnished, If not already intimated through contribution card.

PF Withdrawl Form

Attach herewith PF Withdrawal form like Form 10C, form 19 and describe the procedure for it.

Please find the details below.

1. Use the appropriate form for claiming Provident Fund Pension, withdrawal benefit/scheme certificate, Employees Deposit Linked Insurance benefit, etc. as given below :-

• Form-19: To claim final settlement of Provident Fund by a member.
• Form-10-C: To claim withdrawal benefit/scheme certificate under Employees Pension Scheme.

2. Ensure that all columns of the application are filled completely.

3. Information in the application form relating to name, a/c no. should agree with the details
available with Employees Provident Fund Organization; which were furnished by the employer at the time of enrolling to Provident Fund.

4. Application should be signed by the member/claimant.

5. It should be attested by the former employer. In case attestation by the former employer is not possible, it should be got attested by any other authorized official specified with application form.

6. Application for final settlement can be sent by a member on completion of 2 months from the date of leaving service, if the reason for leaving service is other than superannuation, medical ground, retrenchment and V.R.S./ Female members getting married etc.

7. Desired mode of payment can be given legibly, if the amount involved is more than Rs. 2000/-. The amount will sent by deposit in payees’ bank a/c. To facilitate this, Bank a/c no., name and address of the bank should be furnished. An advance stamped receipt should also accompany this application.

8. Application may be supported by the return Form-10, showing the details of leaving service and details of contribution for the year in Form-3A, if not sent earlier by the employer. (This will be taken care by the concerned employer)
