28<\/strong><br \/>\n<strong>\u00a0<\/strong><\/p>\n<p style=\"text-align: center;\">Prescribed under Rule 124<br \/>\n<strong>ABSTRACT OF THE FACTORIES ACT, 1948 AND THE &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;.<\/strong><br \/>\n<strong>FACTORIES RULES,&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;..<\/strong><br \/>\n<strong>\u00a0<\/strong><br \/>\n<strong>(<\/strong>To\u00a0 be\u00a0 affixed in a conspicuous and convenient place at or \u00a0near\u00a0 the main entrance to<br \/>\nthe factory<strong> )<\/strong><br \/>\n<strong>\u00a0<\/strong><br \/>\n<strong>Interpretation<\/strong><\/p>\n<p>1.\u00a0\u00a0\u00a0\u00a0\u00a0 \u0093Factory\u0094 means any premises including the precincts thereof\u00a0 &#8211;<\/p>\n<p>(i) wherein ten or more workers are working, or were working on any day of the preceding twelve months, and in any part of which a manufacturing process is being carried on with the aid of power, or is ordinarily so carried on, or whereon\u00a0 twenty or more workers are working, or were working on any day of the preceding twelve months, and in any part of which a manufacturing process is being carried on without the aid of power, or is ordinarily so carried on but\u00a0 does not include a mine subject to the operation of\u00a0 the\u00a0 Mines\u00a0\u00a0 Act,\u00a0 1952\u00a0 (35 of 1952), or a mobile unit belonging\u00a0 to\u00a0 the\u00a0 armed\u00a0 forces\u00a0 of the Union, a railway running shed or a hotel, restaurant or eating place.<\/p>\n<p>Explanation\u00a0 :-\u00a0 For\u00a0 computing the number\u00a0 of\u00a0 workers\u00a0 for\u00a0 the\u00a0 purposes of this clause all the workers in different relays in a day\u00a0 shall be taken into account.<\/p>\n<p>2\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 .\u0093Worker\u0094\u00a0 means\u00a0 a person employed, directly or through\u00a0 any\u00a0 agency (including a\u00a0 contractor)\u00a0 with\u00a0 or without the\u00a0 knowledge of\u00a0 the principal employer,\u00a0 whether for remuneration or not, in any manufacturing\u00a0 process, or in any other kind of work incidental to, or connected with, the manufacturing process, or the subject of\u00a0 the manufacturing process; but does not include any member of the armed\u00a0 forces of the Union.<\/p>\n<p>3.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 \u0093Manufacturing process\u0094 means any process for\u00a0 &#8211;<\/p>\n<p>(i)\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 making,\u00a0 altering, repairing, ornamenting,\u00a0 finishing,\u00a0 packing,\u00a0 oiling,\u00a0 washing,\u00a0 cleaning,\u00a0 breaking\u00a0 up,\u00a0\u00a0 demolishing, or otherwise\u00a0 treating or adapting any article or substance with\u00a0 a\u00a0 view to its use, sale, transport, delivery or disposal, or<\/p>\n<p>(ii)\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 pumping oil, water, sewage or any other substances; or<\/p>\n<p>(iii)\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 generating, transforming or transmitting power; or<\/p>\n<p>(iv)\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 composing\u00a0\u00a0 types\u00a0 of\u00a0 printing,\u00a0 printing\u00a0 by\u00a0\u00a0 letter\u00a0\u00a0 press,\u00a0\u00a0 lithography, photogravure\u00a0 or other similar\u00a0 process\u00a0 or\u00a0 book\u00a0\u00a0 binding; or<\/p>\n<p>(v)\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 constructing, reconstructing, repairing, refitting, finishing or\u00a0 breaking up ships or vessels ; or<\/p>\n<p>(vi)\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 preserving or storing any article in cold storage.<\/p>\n<p>4.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Hours\u00a0 of\u00a0 work for adults (Sections 51 and 54).-\u00a0 No\u00a0 adult\u00a0 worker\u00a0 shall\u00a0 be required or allowed to work in a factory for more than\u00a0 48 hours in any week and for more than 9 hours in any day.<\/p>\n<p>5.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Relaxation\u00a0 of hours of work for adult (Section 64) .- The ordinary limits on working hours of adults may be relaxed in certain\u00a0 special\u00a0 cases,\u00a0 e.g.,\u00a0 workers engaged on urgent repairs;\u00a0 in\u00a0 work in the\u00a0 nature\u00a0 or preparatory or complementary work which must\u00a0 necessarily\u00a0 be\u00a0 carried on outside the limits laid down for the general working of the factory; in work which is necessarily so intermittent\u00a0 that the intervals for rest; in any work which for technical reasons must\u00a0 be carried on continuously; in making or supplying articles of prime\u00a0 necessity\u00a0\u00a0 which\u00a0 must\u00a0 be\u00a0 made\u00a0 or supplied\u00a0 every\u00a0 day; in a manufacturing process which cannot be carried on except<br \/>\nduring fixed\u00a0\u00a0 seasons,\u00a0 or at times dependent on the irregular action\u00a0 of\u00a0 natural forces;\u00a0 in engine rooms or boiler houses or in attending\u00a0 to\u00a0 power plant or transmission machinery; in the printing of news papers, who are held up on account of the breakdown of machinery; in the loading or unloading of railway wagons or lorries or trucks; and in any work\u00a0 which is notified by the State Government in the Official gazette as\u00a0 a work of national importance.<br \/>\nExcept\u00a0 in\u00a0 the\u00a0 case of urgent repairs, the\u00a0 relaxation\u00a0 shall\u00a0 not\u00a0 exceed the<br \/>\nfollowing limits of work inclusive of overtime :-<\/p>\n<p>(i)\u00a0 the\u00a0 total number of hours of work in any day shall\u00a0 not\u00a0 exceed\u00a0 ten;<br \/>\n(ii) the spread over inclusive of intervals for rest, shall not exceed\u00a0 12 hours in any one day;<br \/>\n(iii) the total number of hours of work in a work, including overtime,\u00a0 shall not<br \/>\nexceed sixty;<br \/>\n(iv) the\u00a0 total\u00a0 number of hours of overtime work\u00a0 shall\u00a0 not\u00a0 exceed\u00a0 fifty for any one quarter.<\/p>\n<p>6.\u00a0 Payment for overtime (Section 59).- Where a worker works in a factory for more than 9 hours in any day or for more than 48\u00a0 hours\u00a0 in\u00a0 any week, he shall, in respect of overtime work, entitled to wages at the rate of twice his ordinary rate of wages.<\/p>\n<p>7. Exemption of supervisory staff (Section 64).- Chapter VI, other than\u00a0\u00a0 the<br \/>\nprovisions of clause (b) of sub-section (1) of section 66 and of\u00a0 the proviso to that sub-section, of the Act-Working hours of\u00a0 adults &#8211;\u00a0 does\u00a0 not apply to persons holding positions\u00a0 of\u00a0 supervision\u00a0 or\u00a0\u00a0 management or are employed in a confidential position in a\u00a0 factory, provided\u00a0 that where the ordinary rate of wages of such person\u00a0 does\u00a0 not\u00a0 exceed\u00a0 rupees\u00a0 seven hundred and fifty\u00a0 per\u00a0 month, they\u00a0 are\u00a0 entitled\u00a0 to extra wages in respect of overtime work\u00a0 under\u00a0 Section 59.<\/p>\n<p>8. Weekly\u00a0 holiday\u00a0 (Adults) (Section 52).- No adult\u00a0 worker\u00a0 shall\u00a0 be\u00a0 required\u00a0 or allowed to work in a factory on the first day\u00a0 of\u00a0 the week, unless &#8211;<\/p>\n<p>(a)\u00a0 he\u00a0 has, or will have, a holiday for a whole day on one\u00a0 of\u00a0 the\u00a0 three days immediately before or after the said day, and<\/p>\n<p>(b)\u00a0 the\u00a0 manager\u00a0 of\u00a0 the factory has, before the said\u00a0 day\u00a0 or\u00a0 the\u00a0 substituted day under clause (a) whichever is earlier, &#8211;<\/p>\n<p>(i) delivered\u00a0 a\u00a0 notice at the office of the Inspector\u00a0 of\u00a0 his\u00a0 intention to require the worker to work on the said day\u00a0 and of the day which is to be substituted; and<\/p>\n<p>(ii) displayed a notice to that effect in the factory:<\/p>\n<p>Provided that no substitution shall be made which will result in any\u00a0 worker<br \/>\nworking\u00a0 for more than ten days consecutively without a holiday for a\u00a0 whole day.<\/p>\n<p>9. Compensatory holidays (Section 53)- Where a worker in a factory, as\u00a0 a result of exemption from the ordinary provision relating to weekly holidays,\u00a0 is\u00a0 deprived of any of the weekly holidays, he\u00a0 shall\u00a0 be allowed,\u00a0 within the month in which the holidays were due to him\u00a0 or within\u00a0\u00a0 the\u00a0\u00a0 two\u00a0 months\u00a0 immediately\u00a0\u00a0 following\u00a0 that\u00a0\u00a0 month, compensatory holidays of equal number of the holidays so lost.<br \/>\n10. Intervals\u00a0 for rest for adults (Section 55 and 56).- The periods\u00a0 of work\u00a0 of adult workers in a factory each day shall be fixed that\u00a0 no\u00a0 period\u00a0 shall exceed 5 hours and that no worker shall work for\u00a0 more\u00a0\u00a0 than 5 hours before he has had an interval for rest of at least half an\u00a0 hour\u00a0 and\u00a0 that inclusive of his intervals for\u00a0 rest\u00a0 shall not\u00a0 spread\u00a0 over more than ten and a half hours in any day or, with\u00a0 the permission of the Chief Inspector in writing, 12 hours.<br \/>\n11. Prohibition of double employment (Section 60,71 &amp; 99).- No child or, except in certain circumstances, an adult worker, shall be\u00a0 required or allowed to work in any factory on any day on which he has already been working in\u00a0 any other factory. If\u00a0 a\u00a0 child works in a factory on any day on which he \u00a0has\u00a0 already been working in another factory, the parent or guardian of the child or the person having custody of or control over him or obtaining any direct benefit from his wages, shall be punishable with fine,\u00a0 which may extend to Rs. 50 unless it appears to the court that the child so worked without the consent or connivance of such parent, guardian or\u00a0\u00a0 person.<\/p>\n<p>12. Prohibition\u00a0 of\u00a0 employment of children under 14 (Section\u00a0 67).-\u00a0 No\u00a0 child who has not completed his fourteenth year shall be required or allowed to work in any factory.<\/p>\n<p>13. ours of work for children (Section 71).- No child shall be employed\u00a0 or\u00a0 permitted to work in any factory for more than four and\u00a0 a\u00a0 half hours\u00a0 in\u00a0 any\u00a0 day\u00a0 and during\u00a0 the\u00a0 period\u00a0 of\u00a0 at\u00a0 least\u00a0 twelve\u00a0\u00a0 consecutive\u00a0 hours which shall include the interval between 10\u00a0 P.M. and\u00a0 6. A.M.\u00a0 The\u00a0 periods of work of all\u00a0 children employed\u00a0 in\u00a0 a\u00a0\u00a0 factory shall be limited to two shifts which shall not\u00a0 overlap or spread over more than 5 hours each and each child shall be\u00a0 employed in only one of the relays.<\/p>\n<p>The provision relating to weekly holidays shall also apply to\u00a0 child\u00a0 workers\u00a0 and no\u00a0 exemption form this provision may\u00a0 be\u00a0 granted in respect\u00a0 of any child.<\/p>\n<p>14. Pohibition of employment of women (Section 66).- No women shall\u00a0 be\u00a0 required or allowed to work in any factory except between the\u00a0 hours of 6 A.M. and 7 P.M.The State Government may vary those limits\u00a0 or\u00a0 exempt\u00a0 this restriction in case of women working in fish-curing\u00a0 or fish-canning factories.<\/p>\n<p>15. \u00a0\u00a0\u00a0\u00a0\u00a0 Leave\u00a0 with wages (Section 79, 80 and 83 and Rules).-\u00a0 Every\u00a0 worker\u00a0 who has worked for a period of 240 days or more in a factory\u00a0 during a calendar year shall be allowed during the subsequent calendar year\u00a0 leave with wages for a number of days calculated at the rate of &#8211;<\/p>\n<p>(i)\u00a0\u00a0 if an adult, one day for every twenty days of work performed\u00a0 by\u00a0\u00a0\u00a0 him during the previous calendar year; and<\/p>\n<p>(ii)\u00a0 if\u00a0 a child, one day for every 15 days of work performed by\u00a0 him\u00a0 during the previous calendar year.<\/p>\n<p>Explanation. 1. For the purpose of this sub-section \u0096<br \/>\n(a)\u00a0\u00a0\u00a0\u00a0 any days of lay off, by agreement or contract or as\u00a0 permissible\u00a0 under the standing orders;<\/p>\n<p>(b)\u00a0\u00a0\u00a0\u00a0 in the case of female worker, maternity leave for any number \u00a0of\u00a0 days not exceeding twelve weeks; and<\/p>\n<p>(c)\u00a0\u00a0\u00a0\u00a0\u00a0 the leave earned in the year prior to that in which the leave is\u00a0\u00a0 enjoyed; shall\u00a0 be\u00a0 deemed\u00a0 to be days on which the worker has\u00a0 worked\u00a0 in\u00a0 a\u00a0\u00a0 factory for the purpose of computation of the period of 240 days\u00a0 or\u00a0 more, but he shall not earn leave for these days.<\/p>\n<p>Explanation 2.- The leave admissible under this sub-section shall be exclusive of all holidays whether occurring during or at either end of the period of leave.<br \/>\nFor the leave allowed to him, a worker shall be paid at a rate equal to\u00a0 the\u00a0 daily average of his total full-time earning, for the\u00a0 days\u00a0 on\u00a0 which he actually worked during\u00a0 the month immediately preceding the leave exclusive of any overtime and bonus, but inclusive of dearness\u00a0\u00a0 allowance and the cash equivalent of the advantage accruing\u00a0 through\u00a0\u00a0 the\u00a0 concessional\u00a0 sale to\u00a0 the worker of\u00a0 food grains\u00a0 and\u00a0 other\u00a0 articles.<\/p>\n<p>A worker whose service commences otherwise than on the first day\u00a0 of\u00a0 January shall be entitled to leave with wages at the rate\u00a0 indicated\u00a0\u00a0 above,\u00a0 if he has worked for two-thirds of the total number of\u00a0 days\u00a0 in the remainder of the calendar year.<\/p>\n<p>If\u00a0 a\u00a0 worker is discharged or dismissed from service or\u00a0 quits\u00a0 his\u00a0 employment or is supperanuated or dies while in service, during\u00a0 the\u00a0 course\u00a0 of the calendar year,he or his heir or nominee as the\u00a0 case may\u00a0 be, shall be entitled to wages in lieu of the quantum of\u00a0 leave\u00a0 to\u00a0 which\u00a0\u00a0 he\u00a0 was\u00a0 entitled\u00a0 immediately\u00a0 before\u00a0 his\u00a0 discharge, dismissal,\u00a0 quitting\u00a0 of\u00a0 employment,\u00a0 superannuation\u00a0 or death,calculated\u00a0 at the rates specified above, even if he had not\u00a0 worked\u00a0\u00a0 for the entire period specified above.\u00a0 Such payment shall be made \u0096<\/p>\n<p>(i)\u00a0\u00a0 whether\u00a0\u00a0 the\u00a0 worker\u00a0 is\u00a0 discharged\u00a0 or\u00a0 dismissed\u00a0 or\u00a0 quits\u00a0 employment, before the expiry of the second working day from the day of such discharge, dismissal or quitting; and<\/p>\n<p>(ii)\u00a0 where\u00a0 the\u00a0 worker is superannuated\u00a0 or dies while in service, before the expiry of two months from\u00a0 the\u00a0 date\u00a0 of\u00a0\u00a0 such superannuation or death.<br \/>\nIf the employment of a worker who is entitled to leave with wages is\u00a0 terminated\u00a0 by the occupier before he has taken the entire leave\u00a0 to\u00a0 which\u00a0 he is entitled, or if having applied for and having not\u00a0 been\u00a0 granted\u00a0 such leave, the worker quits his employment before\u00a0 he\u00a0 has\u00a0\u00a0 taken\u00a0 the\u00a0 leave,\u00a0 the occupier of the factory shall pay\u00a0 him\u00a0 the\u00a0 amount\u00a0 payable in respect of the leave not taken, and such payment shall be made before the expiry of the second working day after\u00a0 the\u00a0 day\u00a0 on which his employment is terminated and a worker\u00a0 who\u00a0 quits his employment, on or before the next pay day.<\/p>\n<p>The\u00a0 manager\u00a0 shall maintain a register of leave with wages\u00a0 in\u00a0 the\u00a0\u00a0 prescribed Form 20 and shall provide each worker with a book\u00a0 called\u00a0 the \u0093Leave Book\u0094 in the prescribed Form 21.\u00a0 The leave book shall be\u00a0\u00a0 the\u00a0 property of the worker and the manager or his agent\u00a0 shall\u00a0 not\u00a0 demand\u00a0 it\u00a0 except\u00a0 to\u00a0 make entries of the\u00a0 dates of\u00a0 holidays\u00a0 or\u00a0\u00a0 interruptions in service, and shall not keep it for more than a week at\u00a0 a\u00a0 time.\u00a0 If a worker loses his leave book,\u00a0 the\u00a0 manager\u00a0 shall\u00a0\u00a0 provide\u00a0 him with\u00a0 another\u00a0 copy\u00a0 on\u00a0 payment of\u00a0 paise &#8230;&#8230;&#8230;&#8230;..and shall complete it from his record.<\/p>\n<p>Health<br \/>\n16. Cleanliness\u00a0 (Section 11).- Except in cases specially exempted,\u00a0 all\u00a0\u00a0\u00a0 inside\u00a0 walls and partitions, all ceilings or\u00a0 tops of rooms and\u00a0 all\u00a0\u00a0 walls, sides and tops of passages and stair-cases in a factory shall\u00a0 be\u00a0 kept white washed or colour washed.\u00a0 The\u00a0\u00a0 whitewashing\u00a0\u00a0 or\u00a0\u00a0 colour washing shall be carried out at least once in every period\u00a0 of\u00a0\u00a0 fourteen\u00a0 months.\u00a0 The floor of every workroom shall be cleaned\u00a0 at\u00a0 least\u00a0 once\u00a0 in\u00a0 every week by washing,\u00a0 using\u00a0 disinfectant,\u00a0 where necessary, or by some other effective method.<\/p>\n<p>17.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Disposal\u00a0 of\u00a0 wastes\u00a0 and\u00a0 effluents\u00a0 (Section 12).-\u00a0\u00a0 Effective\u00a0\u00a0 arrangements shall\u00a0 be made in every factory for the\u00a0 treatment\u00a0 of\u00a0 wastes\u00a0 and\u00a0 effluents due to the manufacturing process\u00a0 carried\u00a0 on\u00a0 therein, so as to render them innocuous,and for their disposal.<\/p>\n<p>18. \u00a0\u00a0\u00a0\u00a0\u00a0 Ventilation\u00a0 and temperature (Section 13).- Effective\u00a0 and\u00a0 suitable\u00a0\u00a0\u00a0 provision shall\u00a0 be\u00a0 made\u00a0 in\u00a0 every\u00a0 factory\u00a0 for\u00a0 securing\u00a0\u00a0 and\u00a0 maintaining\u00a0\u00a0 in\u00a0\u00a0 every workroom\u00a0 adequate\u00a0 ventilation\u00a0\u00a0 by\u00a0\u00a0 the\u00a0\u00a0\u00a0 circulation\u00a0 of fresh air and such a temperature as will\u00a0 secure\u00a0 to\u00a0 workers therein reasonable conditions of comfort and prevent\u00a0 injury to health.<\/p>\n<p>19. \u00a0\u00a0\u00a0\u00a0\u00a0 Overcrowding (Section 16).- Unless exemption has been granted, there shall be in every workroom of a factory in existence on the date\u00a0 of commencement\u00a0 of this Act at least 350 cubic feet and of\u00a0 a\u00a0 factory\u00a0 built after the commencement of this Act at least 500 cubic feet\u00a0 of\u00a0 space\u00a0 for\u00a0 every worker employed therein, and for this\u00a0 purpose\u00a0 no account shall be taken of any space which is more than 14 feet above\u00a0 the level of the floor of the room.<\/p>\n<p>20.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Lighting (Section 17).- In every part of a factory where workers are\u00a0 working\u00a0\u00a0 or\u00a0 passing,\u00a0 there\u00a0 shall\u00a0 be\u00a0 provided\u00a0 and\u00a0\u00a0 maintained\u00a0 sufficient and suitable lighting, natural\u00a0 artificial, or both.<\/p>\n<p>21. Drinking\u00a0 water (Section 18 and Rules).- In every factory\u00a0 effective\u00a0 arrangements shall\u00a0 be\u00a0 made to provide and\u00a0 maintain\u00a0 at\u00a0 suitable points\u00a0 conveniently\u00a0 situated for all workers employed\u00a0 therein, a sufficient supply of wholesome drinking water. In\u00a0 every\u00a0 factory\u00a0 wherein more than\u00a0 250\u00a0 workers\u00a0 are\u00a0 ordinarily\u00a0 employed\u00a0 the drinking water shall, during hot weather be cooled\u00a0 by\u00a0 ice or other effective methods.\u00a0 The cooled drinking water shall\u00a0 be\u00a0\u00a0 supplied\u00a0 in\u00a0 every\u00a0 canteen,lunchroom and\u00a0 restroom\u00a0 and\u00a0 also\u00a0 at\u00a0\u00a0 conveniently accessible points throughout the factory.<\/p>\n<p>22. Latrines and\u00a0 urinals\u00a0 (Section 19 and Rules).-\u00a0 In\u00a0 every\u00a0 factory\u00a0 sufficient\u00a0 latrine and urinal accommodation of the prescribed\u00a0 types\u00a0\u00a0 (separate\u00a0 enclosed accommodation for male and female workers)\u00a0 shall\u00a0 be\u00a0 provided conveniently situated and accessible to workers at\u00a0 all times\u00a0 while they are at the factory. Every latrine shall be\u00a0 under\u00a0 cover\u00a0 and so partitioned off as to secure privacy and shall have\u00a0 a\u00a0\u00a0 proper\u00a0 door\u00a0 and\u00a0 fastenings.\u00a0 Sweepers\u00a0 shall\u00a0 be\u00a0 employed whose\u00a0\u00a0 primary\u00a0 duty\u00a0 it\u00a0 would be to keep\u00a0 clean\u00a0 latrines,\u00a0 urinals\u00a0 and washing places.<\/p>\n<p>23. Spittoons (Section 20).- In every factory, there shall be provided a\u00a0 sufficient number of spittoons of the type prescribed in convenient places and they shall be maintained in clean and hygienic condition.\u00a0\u00a0 No\u00a0 person shall spit within the premises of factory except\u00a0 in\u00a0 the\u00a0 spittoons\u00a0 provided for purpose.\u00a0 Whoever spits in contravention\u00a0 of\u00a0\u00a0 this\u00a0 provision\u00a0 shall be punishable with fine\u00a0 not\u00a0 exceeding\u00a0 five rupees.<\/p>\n<p>Safety<br \/>\n24. Fencing of machinery (Section 21).- In every factory dangerous parts\u00a0 of<br \/>\nmachinery\u00a0 e.g., every moving part of a prime mover and every flywheel<br \/>\nconnected to prime mover, etc. etc. shall be securely fenced\u00a0 by safeguards of substantial construction which shall be\u00a0 constantly\u00a0 maintained\u00a0 and kept in position while the parts of\u00a0 machinery\u00a0 they are fencing in motion or in use.<\/p>\n<p>25. Work on or near machinery in motion (Section 22).- No woman or young\u00a0\u00a0\u00a0 person shall be allowed in any factory to clean, lubricate or adjust\u00a0\u00a0 any\u00a0 part\u00a0 of\u00a0 a prime mover or any\u00a0 transmission\u00a0 machinery\u00a0 is\u00a0 in\u00a0 motion, or to clean, lubricate or adjust any part of any machine\u00a0 if\u00a0 the\u00a0 cleaning,lubrication or adjustment thereof would\u00a0 expose\u00a0 the woman or young person to risk of injury from any moving part either\u00a0 of that machine or of any adjacent machinery.<\/p>\n<p>26. Employment of young persons on dangerous machines (Section 23).-\u00a0 No\u00a0 young person\u00a0 shall work at any machine declared\u00a0 to\u00a0 be\u00a0 dangerous unless\u00a0 he\u00a0 has been fully instructed as to the dangers\u00a0 arising\u00a0 in\u00a0 connection\u00a0 with the machine and precautions to be observed and\u00a0 has received\u00a0 sufficient\u00a0 training in work at the machine or is\u00a0 under adequate\u00a0 supervision by a person who has a thorough knowledge\u00a0 and\u00a0 experience of the machine.<\/p>\n<p>27. \u00a0\u00a0\u00a0\u00a0\u00a0 Casing\u00a0 of new machinery (Section 26).- In all machinery\u00a0 driven\u00a0 by\u00a0 power\u00a0 and installed in any factory after the commencement\u00a0 of\u00a0 this\u00a0 Act,\u00a0 every set screw,bolt or key on any revolving shaft,\u00a0 spindle, wheel\u00a0 or pinion shall be so sunk,encased or otherwise\u00a0 effectively\u00a0 guarded\u00a0 as to prevent danger; all spur, worm and other toothed or friction gearing which does not require frequent adjustment while\u00a0 in\u00a0 motion shall be completely encased, unless it is so situated\u00a0 as\u00a0 to as safe as it would be if it were completely encased.<br \/>\nWhoever\u00a0 sells\u00a0 or lets on hire or, as agent of a seller\u00a0 or\u00a0 hirer,\u00a0 causes\u00a0 or<br \/>\nprocures to be sold or let on hire, for use in a\u00a0 factory\u00a0 any\u00a0 machinery\u00a0 driven\u00a0 by power which does not\u00a0 comply\u00a0 with\u00a0 these\u00a0 provisions or any rules made under this section, shall be punishable\u00a0 with\u00a0 imprisonment\u00a0 for a term which may extend to three\u00a0 months\u00a0 or with fine which may extend to five hundred rupees or with both.<br \/>\n28. Protection of eyes (Section 35 and Rules).- Effective\u00a0 screens\u00a0 or suitable<br \/>\ngoggles\u00a0 shall be provided for the protection of persons\u00a0 employed in or in the immediate vicinity of processes which\u00a0 involve\u00a0 risk of injury to eyes from particles or fragments thrown off in the\u00a0 processes\u00a0 or\u00a0 which\u00a0 involve risk of injury to eyes by\u00a0 reason\u00a0 of\u00a0\u00a0 exposure to excessive light or infra-red or ultra-violet radiations.<\/p>\n<p>31. Precautions\u00a0 in case of fire (Section 38 and Rules).- Every\u00a0 factory\u00a0 shall be provided with adequate means of escape in case of fire\u00a0 for the\u00a0 persons<br \/>\nemployed therein.The doors affording exit\u00a0 from\u00a0 any\u00a0 room shall, unless they are of sliding type, be constructed to\u00a0 open\u00a0 outwards.\u00a0\u00a0 Every\u00a0 window, door or other exit affording a\u00a0 means\u00a0 of\u00a0 escape\u00a0 in\u00a0 case of fire, other than the means of exit\u00a0 in\u00a0 ordinary\u00a0 use,\u00a0 shall be distinctively marked.\u00a0 Effective and clearly audible\u00a0\u00a0 means of giving warning in case of fire to every person employed\u00a0 in\u00a0 the factory shall be provided.\u00a0 Effective measures shall be taken to\u00a0 ensure\u00a0 that\u00a0 wherein\u00a0 more\u00a0 than\u00a0 twenty\u00a0 workers\u00a0 are\u00a0 ordinarily\u00a0 employed\u00a0 in any place above the ground floor, or wherein\u00a0 explosive\u00a0 or highly inflammable materials are used or stored, all the\u00a0 workers\u00a0 are familiar with the means of escape in case of fire and have\u00a0 been\u00a0 adequately trained in the routine to be followed in such case.<\/p>\n<p>Welfare<br \/>\n32. \u00a0\u00a0\u00a0\u00a0\u00a0 Washing\u00a0 facilities\u00a0 (Section\u00a0 42\u00a0 and\u00a0 Rules).-\u00a0 In\u00a0 every\u00a0 factory\u00a0\u00a0 adequate\u00a0 and suitable facilities for washing shall be provided\u00a0 and maintained\u00a0 for\u00a0 the use of the workers\u00a0 therein.\u00a0\u00a0 Such\u00a0 facilities\u00a0\u00a0 shall\u00a0 include\u00a0 soap\u00a0 and nail brushes or other\u00a0 suitable\u00a0 means\u00a0 of\u00a0 cleaning\u00a0 and\u00a0 the facilities shall be conveniently\u00a0 accessible\u00a0 and\u00a0 shall be kept in a clean and orderly condition.<\/p>\n<p>If female workers are employed separate washing facilities shall\u00a0 be\u00a0 provided and\u00a0 so enclosed or screened that the\u00a0 interiors\u00a0 are\u00a0 not\u00a0 visible from any place where persons of the other sex work or pass.<\/p>\n<p>33. \u00a0\u00a0\u00a0\u00a0\u00a0 Facilities for storing and drying clothing (Section 43 and\u00a0 Rules).-\u00a0 In\u00a0 the case of certain dangerous operations e.g.,\u00a0 lead\u00a0 processes, liming\u00a0 and tanning of raw hides and skins etc. suitable places\u00a0 for keeping clothing not worn during working hours and for the drying of\u00a0 wet clothing shall be provided and maintained.<\/p>\n<p>34. \u00a0\u00a0\u00a0\u00a0\u00a0 Facilities\u00a0 for\u00a0 sitting (Section 44).- In\u00a0 every\u00a0 factory\u00a0 suitable arrangements\u00a0 for sitting shall be provided and maintained\u00a0 for\u00a0 all\u00a0 workers\u00a0 obliged to work in a standing position in order\u00a0 that\u00a0 they may take advantage of any opportunities for rest which may occur\u00a0 in\u00a0\u00a0 the course of their work.<\/p>\n<p>35. \u00a0\u00a0\u00a0\u00a0\u00a0 First-aid and ambulance room (Section 45).- There shall in every\u00a0 factory\u00a0 be provided and maintained sops to be readily\u00a0 accessible\u00a0 during all working hours first-aid boxes or cupboards equipped\u00a0 with the\u00a0 prescribed contents.\u00a0 Each firstaid box or cupboard\u00a0 shall\u00a0 be kept\u00a0 in\u00a0 the charge of a separate responsible person\u00a0 who holds a certificate\u00a0 in\u00a0 first-aid\u00a0 treatment\u00a0 recognised by\u00a0 the\u00a0 State Government who shall always be available during the working hours of\u00a0 the factory.<\/p>\n<p>In\u00a0 every\u00a0 factory\u00a0 wherein\u00a0 more than 500\u00a0 workers\u00a0 are\u00a0 ordinarily\u00a0 employed there shall be provided and maintained an ambulance room of\u00a0 the prescribed size,containing the prescribed equipment, and in the\u00a0 charge\u00a0 of such medical and nursing staff as may be\u00a0 prescribed\u00a0 and\u00a0 those\u00a0 facilities shall always be made readily available during\u00a0 the\u00a0\u00a0 working hours of the factory.<\/p>\n<p>36. Canteens\u00a0 (Section\u00a0 46 and Rules).- In specified\u00a0 factories\u00a0 wherein\u00a0 more than 250 workers are ordinarily employed, a canteen or canteens\u00a0 shall be provided and maintained by the occupier for the use of\u00a0 the\u00a0 workers.\u00a0 Food, drink and other items served in the canteen shall be\u00a0 sold\u00a0 on a non-profit basis and the prices charged shall be\u00a0 subject\u00a0 to\u00a0 the approval\u00a0 of a Canteen Managing Committee which shall be appointed\u00a0 by\u00a0 the manager and shall consist of an equal\u00a0 number of\u00a0 persons\u00a0 nominated by the occupier and elected by the workers. The\u00a0 number of elected workers shall be in the proportion of 1 for\u00a0 every\u00a0 1,000\u00a0 workers employed in the factory, provided that\u00a0 in\u00a0 no\u00a0 case shall there be more 5 or less than 2 workers on the Committee.\u00a0\u00a0 The Committee shall be consulted from time to time as to the quality and\u00a0\u00a0 quantity of food stuffs to be served in the canteen, the arrangement\u00a0 of\u00a0 the\u00a0 menus,\u00a0 etc. etc.\u00a0 Where the canteen is managed\u00a0 by a<br \/>\nco-operative\u00a0 society, it\u00a0 is\u00a0 not necessary\u00a0 to\u00a0 appoint\u00a0 a\u00a0 Canteen\u00a0 Managing<br \/>\nCommittee and the prices to be charged\u00a0 may\u00a0 include a margin\u00a0 of\u00a0 profit\u00a0 up to\u00a0 a maximum of 5 per cent\u00a0 of\u00a0 its\u00a0 working\u00a0 capital.<\/p>\n<p>37. \u00a0\u00a0\u00a0\u00a0\u00a0 Shelters, restrooms and lunchrooms (Section 47).- In every\u00a0 factory\u00a0 wherein more than 150 workers are ordinarily employed, adequate\u00a0 and\u00a0 a\u00a0 suitable lunchroom,\u00a0 with provision for\u00a0 drinking\u00a0 water,\u00a0 where\u00a0 workers\u00a0 can\u00a0 eat\u00a0 meals brought by them,\u00a0 shall\u00a0 be\u00a0 provided\u00a0 and\u00a0 maintained for the use of the workers.<\/p>\n<p>38. \u00a0\u00a0\u00a0\u00a0\u00a0 Creches (Section 48 and Rules).- In every factory wherein more\u00a0 than\u00a0 30 womenworkers are ordinarily employed there shall be provided and maintained\u00a0 a suitable room or rooms for the use of\u00a0 children\u00a0 under\u00a0 the age of six years of such women.\u00a0 The creche shall be\u00a0 adequately\u00a0 furnished and equipped and in particular there shall be one suitable\u00a0 cot or a cradle with the seating accommodation for the use of\u00a0 each\u00a0 mother\u00a0 while\u00a0 she\u00a0 is\u00a0 feeding or attending to\u00a0 her\u00a0 child,\u00a0 and\u00a0 a\u00a0\u00a0 sufficient supply of suitable toys for older children.<\/p>\n<p>There\u00a0 shall be in or adjoining the creche a suitable\u00a0 washroom\u00a0 for\u00a0\u00a0 the washing of the children and their clothing.\u00a0 An adequate\u00a0 supply\u00a0 of clean clothes, soap and clean towels shall be made available\u00a0 for each child while it is in the creche at least a quarter litre of clean\u00a0 pure milk\u00a0 shall\u00a0 be\u00a0 available\u00a0 for\u00a0 each\u00a0 child\u00a0 on\u00a0 every day\u00a0 it\u00a0 is accommodated\u00a0 in the creche and the mother of such a child shall\u00a0 be allowed\u00a0 in the course of her daily work suitable intervals to\u00a0 feed the\u00a0 child.\u00a0\u00a0 For children above two years of age,\u00a0 there\u00a0 shall\u00a0 be\u00a0 provided, in addition, an adequate supply of wholesome\u00a0 refreshment.\u00a0\u00a0 A\u00a0 suitably\u00a0 fenced\u00a0 and shady open air playground\u00a0 shall\u00a0 also\u00a0 be\u00a0 provided for the older children.<\/p>\n<p>39. Welfare Officers (Section 49).- In every factory wherein 500 or more\u00a0 workers are\u00a0 ordinarily employed the occupier shall employ\u00a0 in\u00a0 the factory such number of Welfare Officers as may be prescribed.<\/p>\n<p>Special Provisions<\/p>\n<p>40. Dangerous\u00a0 operations (Section 87 and Rules).- Employment of\u00a0 women, adolescents\u00a0 and\u00a0 children is prohibited or\u00a0 restricted\u00a0 in\u00a0 certain operations declared\u00a0 to be\u00a0 dangerous,\u00a0 e.g., electroplating, manufacture and repair of electric accumulators, glass\u00a0 manufacture, grinding or glazing of metals, manufacture and treatment of lead and\u00a0 certain compounds of lead, sand blasting, etc.<\/p>\n<p>41. Notice of accidents (Section 88 and Rules).- When an accident occurs\u00a0 which results in the death of any person or which results\u00a0 in\u00a0 such\u00a0 bodily injury to any person as is likely to cause his death, or\u00a0 any dangerous occurrence specified in the schedule annexed hereto takes place in a factory, the manager of the factory shall forthwith send a notice thereof by telephone, special messenger or telegram to\u00a0 the Inspector\u00a0 and\u00a0 the Chief Inspector. When any accident or any dangerous occurrence specified in the schedule annexed hereto, which results\u00a0 in the death of any person or which results in such\u00a0 bodily\u00a0 injury to any person as is likely to cause his death, takes place in a\u00a0 factory,\u00a0 forthwith notice shall be sent also\u00a0 to the\u00a0 District\u00a0 Magistrate\u00a0 or Sub-divisional Officer, to the\u00a0 officer-in-charge\u00a0 of the nearest police station; and to the relatives of the\u00a0 injured\u00a0 or\u00a0 deceased person.<\/p>\n<p><strong>SCHEDULE<\/strong><\/p>\n<p>1.\u00a0\u00a0 Bursting \u00a0of\u00a0 a plant used for containing or supplying\u00a0 steam\u00a0 under\u00a0\u00a0 pressure greater than atmospheric pressure.<\/p>\n<p>2.\u00a0\u00a0\u00a0\u00a0\u00a0 Collapse\u00a0 or\u00a0 failure\u00a0 of a crane, derrick, winch,\u00a0 hoist\u00a0 or\u00a0 other\u00a0 appliances used in raising or lowering persons or goods, or any part\u00a0 thereof, or the overturning of a crane.<\/p>\n<p>3.\u00a0\u00a0\u00a0\u00a0\u00a0 Explosion,\u00a0 fire,\u00a0 bursting\u00a0 out, leakage or escape\u00a0 of\u00a0 any\u00a0 molten\u00a0 metal,\u00a0 or hot liquor or gas causing bodily injury to any person\u00a0 or\u00a0 damage\u00a0 to any room or place in which persons are employed, or\u00a0 fire\u00a0 in\u00a0 rooms\u00a0 of cotton pressing factories when a cotton opener\u00a0 is\u00a0 in\u00a0 use.<\/p>\n<p>4.\u00a0\u00a0\u00a0\u00a0\u00a0 Explosion\u00a0 of\u00a0 a\u00a0 receiver or container used for the\u00a0 storage\u00a0 at\u00a0 a\u00a0 pressure greater\u00a0 than\u00a0 atmospheric pressure of any\u00a0 gas\u00a0 or\u00a0 gases (including\u00a0\u00a0 air) or any\u00a0 liquid\u00a0 or\u00a0 solid resulting \u00a0from\u00a0\u00a0 the\u00a0 compression of gas.<\/p>\n<p>5.\u00a0\u00a0\u00a0\u00a0\u00a0 Collapse or subsidence of any floor, gallery, roof, bridge,\u00a0 tunnel,\u00a0 chimney, wall, building or any other structure.<\/p>\n<p>42. \u00a0\u00a0\u00a0\u00a0\u00a0 Notice of certain diseases (Section 89 and Rules).- Where any worker\u00a0\u00a0 in a factory contracts any of the following diseases, the manager of\u00a0\u00a0 the\u00a0 factory shall send notice in Form 27 thereof forthwith both\u00a0 to\u00a0 the Chief Inspector and the<br \/>\n<strong>Certifying Surgeon :-<\/strong><br \/>\n<strong>\u00a0<\/strong><br \/>\nLead, phosphorus, mercury, manganese, arsenic, carbon bi-sulphide or benzene poisoning; or poisoning by nitrous fumes or by halogens or halogen derivatives of the hydrocarbons of the aliphatic series;\u00a0 or of\u00a0 chrome\u00a0 ulceration,\u00a0 anthrax,silicosis,\u00a0 toxic\u00a0 anaemia,\u00a0 toxic jaundice,\u00a0 primary\u00a0 opitheliomatous\u00a0 cancer\u00a0 of the\u00a0\u00a0 skin,\u00a0\u00a0 or\u00a0 pathological\u00a0 manifestations\u00a0 due to radium or\u00a0 other\u00a0 radio-active\u00a0 substances or x-rays.<\/p>\n<p>43.\u00a0 No\u00a0 charge for facilities and convenience (Section 114).- No fee or charge\u00a0 shall be realised\u00a0 from\u00a0 any\u00a0 worker\u00a0 in\u00a0 respect\u00a0 of\u00a0 any arrangements\u00a0 or\u00a0 facilities to be provided, or\u00a0 any\u00a0 equipments or appliances to be supplied by the occupier under the\u00a0 provisions\u00a0 of\u00a0 this Act.<\/p>\n<p>44. Powers of Inspectors (Sections 9 and 82).- Inspectors have power\u00a0 to inspect factories\u00a0 any\u00a0 time\u00a0 and may\u00a0 require\u00a0 the\u00a0 production\u00a0 of registers,\u00a0 certificates, etc. prescribed under the\u00a0 Act\u00a0 and\u00a0 the\u00a0 Rules.Any Inspector may institute proceedings on behalf of any workers\u00a0 to\u00a0 recover any\u00a0 sum\u00a0 required\u00a0 to be paid by\u00a0 an\u00a0 employer\u00a0 under\u00a0 the\u00a0 provisions relating to<br \/>\nleave with wages, which the employer has\u00a0 not\u00a0 paid.<br \/>\n45. Obligations of workers (Section 97 and 111).- No worker in a factory :<\/p>\n<p>(i) shall\u00a0\u00a0 wilfully\u00a0 interfere\u00a0 with or misuse\u00a0 any\u00a0 appliance, convenience or other\u00a0 thing\u00a0 provided in a factory\u00a0 for\u00a0 the\u00a0 purposes\u00a0 of\u00a0 securing the health,safety\u00a0 or\u00a0 welfare\u00a0 of\u00a0 the\u00a0 workers therein;<\/p>\n<p>(II) shall\u00a0 wilfully\u00a0 and without any reasonable\u00a0 cause\u00a0 do\u00a0 anything likely to<br \/>\nendanger himself or others; and<\/p>\n<p>(iii) shall\u00a0 wilfully\u00a0 neglect to make use of any appliance\u00a0 or\u00a0 other thing<br \/>\nprovided in the factory for the purpose\u00a0 of\u00a0 securing\u00a0 the health or safety of<br \/>\nthe workers therein.<\/p>\n<p>If any worker employed in a\u00a0 factory\u00a0 contravenes\u00a0 any\u00a0 of\u00a0\u00a0 these\u00a0 provisions\u00a0 or any\u00a0 rule\u00a0 or order\u00a0 made\u00a0 thereunder\u00a0 he\u00a0 shall\u00a0 be\u00a0 punishable\u00a0 with imprisonment for a term which may extend\u00a0 to\u00a0 three\u00a0 months, or with fine which may extend to Rs. 00, or with both.<\/p>\n<p>If\u00a0 any\u00a0 worker employed in a factory contravenes any\u00a0 provision\u00a0 of\u00a0\u00a0\u00a0 this\u00a0 Act or any rules or orders made thereunder, imposing any\u00a0 duty\u00a0 or liability on workers,he shall be punishable with fine which\u00a0 may\u00a0 extend to Rs. 20.<\/p>\n<p>46. Certificates of fitness (Sections 69, 70 and 98).- No child who\u00a0 has completed his fourteenth year or an adolescent shall be required or allowed\u00a0 to\u00a0 work\u00a0 in any factory unless a\u00a0 certificate\u00a0 of\u00a0 fitness\u00a0\u00a0 granted\u00a0 with reference to him is in the custody of the\u00a0 manager\u00a0 of\u00a0 the\u00a0 factory\u00a0 and such child or adolescent carries,while he is\u00a0 at\u00a0 work,\u00a0 a\u00a0 token\u00a0 giving a reference to such\u00a0 certificate.\u00a0\u00a0 Any\u00a0 fee payable\u00a0 for\u00a0 such a certificate shall be paid by the occupier\u00a0 and shall\u00a0 not\u00a0 be recoverable from the young person,\u00a0 his\u00a0 parents\u00a0 or\u00a0 guardian.<\/p>\n<p>An adolescent who has been granted a certificate of fitness to\u00a0 work\u00a0 in a factory as an adult and who while at work in a factory\u00a0 carries a token giving reference to the certificate shall be deemed to be an adult for all the purposes of the provisions of the\u00a0 Act relating to the working hours of adults and the employment of young persons. \u00a0An\u00a0 adolescent who has not been granted a certificate of fitness to work in\u00a0 a factory as an adult shall, notwithstanding his age, be\u00a0 deemed\u00a0 to be a child for all the purposes of this Act.<\/p>\n<p>Whoever knowingly\u00a0 uses or attempts to use, as\u00a0 a\u00a0 certificate\u00a0 of\u00a0 fitness\u00a0 granted to\u00a0 himself,\u00a0 a\u00a0 certificate granted\u00a0 to\u00a0 another adolescent to work in a factory as an adult, or who having\u00a0 procured\u00a0 such a certificate knowingly allows it to be used, or an attempt\u00a0 to use\u00a0 it\u00a0 to\u00a0 be made, by another person, shall\u00a0 be\u00a0 punishable\u00a0 with imprisonment\u00a0 for a term which may extend to two months or with\u00a0 fine\u00a0 which may extend to Rs. 100 or with both.<\/p>\n<p>47. \u00a0\u00a0\u00a0\u00a0\u00a0 Registers, notices and returns (Sections 61, 62, 63, 72, 73, 74\u00a0 and 110 and Rules).- A register of adult workers in the prescribed\u00a0 Form 17\u00a0 and a register of child workers in the prescribed Form 19\u00a0 shall\u00a0 be maintained by the manager of every factory.<\/p>\n<p>A\u00a0 notice of periods of work for adults and a notice of\u00a0 periods\u00a0 of\u00a0 work\u00a0 for<br \/>\nchildren\u00a0 in\u00a0 the prescribed forms 16\u00a0 and\u00a0 18\u00a0 shall\u00a0 be\u00a0 correctly\u00a0 maintained\u00a0 and displayed in every\u00a0 factory.\u00a0\u00a0 No\u00a0 adult\u00a0 worker or child shall be required or allowed to work in any\u00a0 factory otherwise\u00a0 than\u00a0 in\u00a0 accordance with\u00a0 their\u00a0 respective notices\u00a0 of\u00a0 periods of work displayed in the factory.<\/p>\n<p>The\u00a0 owners,\u00a0 occupiers or managers of factories\u00a0 shall\u00a0 submit\u00a0 the\u00a0 prescribed periodical returns to the Inspector regularly.<\/p>\n<p><strong><a href=\"https:\/\/www.yourhrworld.com\/formats\/wp-content\/uploads\/2012\/09\/Factories-Act-Abstract.pdf\">Click Here To Download Factories Act Abstract<\/a><\/strong><\/p>\n\n<div style=\"font-size: 0px; height: 0px; line-height: 0px; margin: 0; padding: 0; clear: both;\"><\/div>","protected":false},"excerpt":{"rendered":"<p>I have attached abstract of factories act 1948.
