Dear Friends

I was working with a Company and was given a appointment letter which states the following

1)Your probationary period will be from the date of joining till March 31, 2008.

2) Your performance will be reviewed continuously. If your performance is satisfactory, you will be absorbed in this firm as a regular employee with benefits as per prevailing Firm norms. In case, your performance is not satisfactory, your probationary period may be extended or your services may be discontinued. Present benefits include a minimum Exgratia equivalent to One Month’s Salary, per year of service plus Medical Benefit equivalent to 15 days of Salary, per year of Service.

3) You will be entitled to get benefits for a regular employee as per prevailing norms during your probationary period. However, these benefits will be accrued and will be given to you only after you complete 1 year of service.

4) In an unlikely event if your services are not useful to the organization, your services can be discontinued by giving you a notice of one month. Also a minimum notice of one month will be required from you in case you wish to discontinue your service. However, it is clearly understood and agreed between us that you shall endeavor to stay with the organization till completion of this project or a minimum period of 24 months.


After 31st March 2008 I requested the Company to give me a confirmation letter but they failed to issue the same and I left the Company on 6/04/2008.

Now the Company says that I shall NOT be given Exgratia since I have not completed one year of service and I shall NOT be given my payment till 06/04/2008 since I have not given one months notice, also they are refusing to give me experience certificate.

Kindly let me know what best steps can be taking against the Company.
