Default Permission to work on holidays??

Do we need to take prior permission from Factory Inspector for working on public holidays. I heard that previously it was there, but now nobody takes such permission. I enquired with Factory Inspector's Office, they are also not clear. Anybody can throw some light on this..?
Why I am asking is because, one of our employee met with an minor accident while on duty on 1.5.08 within factory premises. He was enrolled to ESI on 1.11.07. Now, ESI is asking about the permission of Factory Inspector to work on 1.5.08, if there is no permission, he has asked us to give a letter in this regard. Our company's process is continuous in nature, its a dairy. Standing order says mgt can require an employee to work on any holiday, however we need to pay him OT.
Pls advise..
