Lightbulb Breach of commitment

Hi,

As per a email from one of IT firm sent to me, it is said ' I have done breach of commitment', against which I need to pay Rs. 4.2 lacs. As per my understanding, there was a employment clause, that I need to complete 6 months in india, after coming from US on L1 visa. If not, I need to pay $10000. However, in my case, I only stayed in US only for 2 months and came back because of my son's health. I request Management not to send me back. I resigned and completed 4 months with them. During my notice period and my no-dues, they never discussed this breach of commitment.

Please let me know, what should be my course of action. What if, they do a legal case, how strong is their side.

Hi Srilu,

1. Was this clause mentioned in your appointment letter, check and confirm
2. Was there any document signed by you which comprised of this clause in brief
3. When you joined the company did you signing a document without reading
4. If they have not discussed about this clause during your notice period then, you can hire a lawyer and fight a case well before they take a legal action against you.
