Default Dual Employment

Dear all,

Since relieving letters are loosing their value attrition rate in the industry is going high.

Could some one guide me whether dual employment case can be filed against such people?

Whats the procedure for it ? kindly let me know.

Dear Aruna,

In this case, you cannot stop people if they are offer somewhere with good perks.
If somebody leave the company without put up resignation papers and relive from duties. You can sent notice in writing at his residence about his absconding and report for duty. He received your notice and didnot repond, then conduct domestic enquiry by legal expert with issuance of chargesheet and dismissed from services.
If employee put up papers with short notices, you have only option to deduct his notice pay from his dues. Inform all superiors not to acknolwedge any resignation unless there is appropriate notice served by employee as per your co. terms.
Since u r HR guy, try to find out why there is high attrition in your industry. Conduct Satisfaction survey and benchmarking from other co. Bring some good things in your concern to motivate them, offer handsome pacakge while recruiting people & good annual increments to retain the people. Talk with your superior in this regard.
