Default Is an Employee entitled to receive the PF settlement when he has left the Orgn.

Dear All

Wanted to know whether an employee is entitled to receive the PF settlement even when he has resigned and left without being releived officially.

Can he claim his PF amount that was accumulated during his tenure in the organization.

Request to kindly throw light on this issue.

You cannot stop his PF Claims, as per statute, if he completed five years of continuous service you have to pay his Gratuity also, as per Gratuity Act.

You can stop his wages but that also priorily informed to the individual, and you should have strong proof to stop his wages ie, the individual may involved in theft or other unethical practices with respect to the monetary.

I think you have understood the process.
