Default May Day

Dear Members,
I want to know at Factory, is it compulsory to close factory on May Day on 1st of May? If yes then under which act?

This refers to your query about the declaration of May Day (1st May) as closed holiday. In this connection, I would like to inform you that u/s 3 of 'The Orissa Industrial Establishments (National and Festival) Holidays Act 1969 May day is a closed holiday. I would like to reproduce the below for your ready reference.

Section -3

QUOTE

Grant of National and Festival Holidays 1) Every employee shall be allowed in each calendar year a holiday of one whole day on the 26th January[the 1st May], the 15th August and the 2nd October and four other holidays each of one whole day for such festivals as the Inspector may, in consideration with the employer and the employees specify in respect of any industrial establishment.

(2) In addition to the holidays provided in sub-section (1), in the event of any general election or by-election to Parliament or the State Legislative Assembly, the date of every such election as notified by the Election Commission shall be allowed as a holiday of one whole day].

UNQUOTE

You may also refer any such act enacted by the State Govt. concerned in which your organisation is operating.
