Dear sir,
I want to know that if an employee join his duty in jan 2008 and he goes on leave in april 2008 can he is eligible for enjoy EL of current year (jan08 to mar0 in april 2008 or not. Thanks & Regards Naveen |

Dear Naveen,
Since EL/PL is a statutory leave, the entitlement of the same is regulated under the provisions made u/s 79 of the Factories Act 1948 . Under the provisions of Factories Act an employee shall be entitled to avail PF/EL in the year immediately succeeding the calendar year he joined the company. In other words the EL/PL will be credited to his leave Account on the 1st day of January in the immediate succeeding year. Hence, he will not be entitled to avail leave in the same calendar year of his joining. Incase the employee joins on the 1st day of January in a particular year and worked for minimum 240 days in the same year he will be entitled to 1 day PL for every 20 days working. If he joins on a day other than 1st January then he will be entitled to PL/EL proportionately in the next year if he has worked 240 days or two third of the remaining days in the year of joining. For more details, you may refer Section 79 of the Factories Act 1948 wherein the eligibility & entitlement of PL is clearly defined. regds, Prashath |
