Arrow EL during Notice period

Hi Friends,
One of may employee has resigned on 1st june & according to policy he has to pay one months notice period but he wants to leave on 20th . means he would be serving for 20 days 7 he has 10 EL. I n such case how much we have to pay him. 20 days salary or one month salary? If he takes SL during notice period so will it be paid by employer or not?

Plz answer.

Hi ,

In this case you have to pay him full salary of a month to him because earned leaves can be adjusted in notice period. If there is any specification in your policy than the action could be different. But, earned leaves is the satutory right of the employee so you can not stop him taking those leaves though he is in his notice period. For Sick Leaves you don't need pay because it is not mandatory in any statue.
