New York

Dear Mr. Brown,

This is to inform you that as of January 16, 2015, your employment with ABC Corporation Pvt. Ltd. is terminated. You are dismissed from your roles and responsibilities for cause, specifically for insubordination. All sorts of supporting evidences for ever incident that are mentioned below have been complied in your employee file. Here are some of the events which have been responsible for such an action.

On November 10, 2014, a written warning was sanctioned to you for using abusive language in office. The copy of the same letter which was signed by you has been filed in your employee file. On November 26, 2014, you again showed the same kind of obscene behavior against another member of your team. Again a warning letter was issued to you and it included the final warning of dismissing you in case there is third violation.

Again on January 15, 2015, it has been recorded that you have misbehaved and threatened one of the company employees from your department. As this is the third incident in a row which shows that you are not taking our warnings seriously and you do not wish to behave in a professional manner as mentioned in the policies of the company. This being your final violation, we are forced to terminate you immediately as there seems to be no hope for changes in your behavior.

All the documents like the final paycheck, the accrued and unused PTO and all other documents shall be mailed to the address mentioned in your employee file. On January 16, 2015, we have issued a restraining order against you and hence you are not allowed in the distance of 100 meters of company property. The same applies for the employees you have assaulted and threatened. In case you have any queries then you can send that to me in writing on the address mentioned above.

Sample Letter of Termination for Cause

Performance and productivity are essential when a company hires an employee. And when an employee fails to deliver a desired level of performance or doesn’t behave in the good of the company then his termination is called termination for cause. Sometimes there is more than one reason for firing the employee. Usually such a letter is framed by the HR manager or owner of the company and summarizes the employer’s justification for his action. It is always better to include some details of violations and other documented proofs as evidences to prove the allegations.

Here is a format template of termination for cause letter which has been drafted in a formal manner keeping in mind all the basic details which should feature in it.

Sample Letter of Termination for Cause

Date: 2nd February, 2015

General Manager

ABC Corporation Pvt. Ltd.

12 Park Avenue

New York

To,

Mr. Sam Brown

52 Richmond Street

New York

Dear Mr. Brown,

The purpose of this letter is to inform your employment with ABC Corporation Pvt. Ltd. is terminated, effective immediately. This is termination for cause. We have recorded evidences that explain that you have willfully abused your managerial position to take benefits which have hampered the overall image of the organization. Here is the list of events based on which the management has taken such a decision:

On December 20, 2014, it was noticed that you had spent an amount of $ 1,200 on entertaining the team of delegates from Japan without seeking any approval from the financial department. You are aware of the company policy according to which any expenditure above $ 500 should be made after approval from the finance department.

On January 1, 2015, you forcefully asked the finance department to settle your conveyance expenses of $ 1,000 which is beyond the higher limits set by the company. As per company policy, no reimbursement shall be made for personal conveyance usage. There is no possibility that you could have spent such a large sum of money on taking clients out.

On January 10, 2015, we have been informed by one of our associates that you have asked them for heavy discounts on the services offered by their company for your personal use. As per our rules, you cannot use the name of the company for your personal benefits as it clearly hampers the image of the company.

Each and every policy of the company has been very clearly mentioned in the handbook and these are also mentioned during the training sessions to bring clarity. You have been one of the star trainers at our company who take orientation sessions for the new recruits and it is in no way possible that you are not aware of these basic policies.

You are expected to return any of the company properties which you have not surrendered yet during the period of one week after receiving this letter. You were handed over a set of documents consisting of details related with your paycheck, pay for unused PTO and commission pay at the meeting. In case you have any questions, you can always write to me on the address mentioned in the letter.

Regards,

Mr. Sam Jackson

Dear Mr. Brown,

The purpose of writing this letter is in reference to your employee contract that is soon to expire on February 10, 2015. You have all the option to renew it at our discretion. During this period of our association, our company has been quite impressed and pleased with your working style and quality of work you have delivered. But we have decided that we will not be renewing the contract at present because the markets are really dull. Due to slow work conditions we are compelled to end the contact 3 weeks early from the actual date. Hence, your employee status with ABC Corporation Pvt. Ltd. will be terminated as of January 20, 2015.

On the last day of your employment, you will receive your last paycheck. As per the clauses stated in the contract, you will be paid for an additional one week of work but you will not be entitled to benefit pay. This amount will reflect in your final paycheck. Moreover, you will receive an e-mail stating all the other benefits and pay that you are entitled to as per the contract.

I request you to please return the company properties mentioned below, that have been in your possession, on or before January 20, 2015: laptop, LED monitor, Canon printer, mouse, keyboard, speakers, paper supplies and office stationery. From today onwards all your official ids and passwords to all client accounts will be disabled. In the coming days, you will only be involved in tasks that do not involve access to confidential information. This is something strictly professional and as per the rules of the company and has nothing to do with our confidence in you.

The company is quite impressed with your work and if you request then I will be happy to supply you with a letter of recommendation. You may ask for the same from other managers with whom you have worked in this organization. In case you have any questions then please feel free to call me at 123-45678.

I wish you all the best for future. I also invite you to stay connected with our website and apply for new contracts in future.

Dear Mr. Jackson,

As you are aware of the fact, I was placed on probation on November 16, 2014 due to some performance issues. I was told that once I am able to complete all the requirements of my probation I would be eligible to return to my original status of employment. I am highly elated to inform you that as of today, January 17, 2015, I have completed all the requirements of my probation. Hence, I respectfully request you to please review the early termination of my probation period.

It was on November 20, 2014 that I enrolled for the Effective Leadership course which was announced by the human resource department. On December 15, 2014, I received my certificate for this course. I also enrolled myself for Teamwork Building Program which is compulsory as per probation requirements on December 20, 2014. I also enrolled for a certificate course in Communication Skills the certificate of which I received on January 5, 2015.

As told by the company, the duration of my probation was 6 months. But because I have been able to meet all the requirements of probation much before the completion of the time, I believe that I have earned the right to ask you to please reevaluate my case. Last month I received an invitation to become a member of idea generation team of our company which is quite an esteem membership and I have worked really very hard to become a member of this team which works on innovations. I have been praised for my ideas and their execution along with my leadership qualities and effective communication skills.

I would like to request you to please arrange an in-person meeting where we may discuss this matter in detail. I have already had a word with my manager, Ms. Grace Cole, about my early termination from probation. She has expressed her consent for the same and she is ready to submit her will in writing at your request.

Looking forward to hear from you. For any queries, you can contact me at work or you can always call me at 123-456789.

Thanking in anticipation

Yours sincerely,

Sam Brown

Dear Mr. Brown,

The purpose of this letter is to inform you that as of January 17, 2015 your employment with ABC Corporation Pvt. Ltd. is being terminated for cause. It has been reported by your manager, Mr. Ray Smith, that you have not reported to work from last 6 days and there has been no information from your side to explain your absence. Mr. Smith tried contacting you on the phone number submitted in your employee file on January 12, January 13 and January 14, 2015 but he could not get in touch with you. Hence, based on this kind of absence we have determined that you have abandoned your job with our company.

Sample Wrongful Termination Letter To Employer

Terminating an employee is never easy. It demands taking into consideration all the details and reviewing it from legal point of view. But despite that sometimes people are wrongly terminated by mistake or because of ambiguity of facts and evidences. In such a case, the best way to go ahead is by writing a wrongful termination letter to the employer stating your case thereby getting this attention on the wrong firing. It should contain all the details because of which you feel that termination is not justified. Make sure you include all the proofs which support your statement.

Below is given a professionally drafted example template for your reference so that you can draft a customized letter as per your need, consisting of all the details in a formal and informative manner.

Wrongful Termination Letter To Employer Sample

Date: January 22, 2015

Mr. Sam Brown

52 Richmond Street

New York

To,

Mr. Andy Jackson

Human Resource Manager

ABC Technologies Pvt. Ltd.

12 Park Avenue

New York

To,

Dear Mr. Jackson,

This is in response to the certificate letter that was issued by you on January 14, 2015. As per that letter, my employment with ABC Technologies Pvt. Ltd. was terminated with immediate effect on January 14, 2015, “no call, no show” clause. As mentioned in the letter that I was absent from work on January 10, 2015 without prior information to my reporting manager. And this happened for the fourth time during a period of eight months that I was missing from work without any information. I would like to present my part on the evidences that have been mentioned in your letter.

As per the schedule, I was suppose to be in office on January 10, 2015 and I agree that I was missing from work without information but it is for the first time it has happened in the last eight months. I have been absent thrice from work during this duration but I have always managed to inform my day manager.

As mentioned in the evidences that you have enclosed with the letter, I was missing from work on September 6, September 7 and September 9, 2014 with my name clearly highlighted and marked with “no call no show” remark. I have reviewed your evidence and now please have a look at mine.

I am quite aware of the company policy, according to which, any change in schedule must be approved well in advance and these changes should be signed by the manager. On September 6, 2014, when I was coming for work, on my way to office, I met with an accident and was hospitalized for 2 days because I had been injured. Due to such an emergency, I could not have the approval of the manager in advance. But my wife called the day manager, Mr. Andrew James on September 6, 2014 at 10.30 a.m. to inform him about my accident and condition. When I joined my duty on September 10, 2014, I was told by Mr. James that the information of my absence from work has been updated in my employee file and no action will be taken as it was an emergency situation.

Please find all the necessary evidences attached with the letter. There is a copy of police report on accident, doctor’s medical report and other hospital bills and records that confirm that I was hospitalized on those three days when I was missing from work. I have no proof to submit that I informed Mr. James and he promised that my absences will be excused. Based on these reasons I request you to please reconsider my termination. I hope to receive your response within one week of the date of this letter.

Thanking in anticipation.

Yours sincerely,
